Terms of use for the JobMarkt24 job platform

These Terms of Service (the "Terms") govern the use of the online job platform JobMarkt24, available at jobmarkt24.ch (the "Platform"). The Platform is operated by Royal Döner AG, Holzwingertstrasse 42-44, 8409 Winterthur, Switzerland (the "Operator", "we").
By creating a user account or using the Platform you agree to these Terms. Additional provisions in sections 5 to 7 apply to employers. In case of discrepancies between the German and the English version, the German version prevails.

1. Scope and contracting parties
1.1These Terms apply to everyone who uses the Platform, in particular to job seekers ("Candidates") and to companies and persons who publish job postings or view candidate profiles ("Employers").
1.2Deviating or supplementary terms of users only become part of the contract if the Operator has expressly agreed to them in writing.
1.3The Platform is intended for persons resident or established in Switzerland. Use from abroad is at the user's own responsibility.
2. Services of the Platform
2.1JobMarkt24 provides a technical infrastructure through which Employers publish and manage job postings and Candidates search for jobs, submit applications, create CVs and communicate with Employers.
2.2The Operator is neither an employment agency nor a party to any employment relationship. An employment contract is concluded exclusively between the Employer and the Candidate. The Operator does not owe any placement success.
2.3Individual features (e.g. AI-assisted matching, suggestions for improving a CV, job alerts) are aids. Their results are non-binding and do not replace your own assessment.
2.4The Operator may develop, change or discontinue features of the Platform at any time, provided that services already paid for are not materially impaired.
3. Registration and user account
3.1A user account is required for most features. Registration requires that you are at least 16 years old and provide truthful and complete information. Changes to your details must be updated in your account promptly.
3.2Employer accounts may only be opened by persons authorised to act on behalf of the company concerned. One company profile per company is intended.
3.3Login credentials must be kept confidential. You are responsible for all activities carried out through your account. If you suspect misuse, notify the Operator immediately at support@jobmarkt24.ch.
3.4The Operator may refuse a registration without giving reasons and may suspend or delete accounts that violate these Terms (see section 11).
4. User obligations and permitted content
4.1The Platform may only be used for its intended purpose of job search and recruitment. In particular, the commercial re-use of third-party data, automated extraction of the Platform (scraping), sending unsolicited advertising and any use that violates laws or third-party rights are prohibited.
4.2You are solely responsible for content you post on the Platform (job postings, company profiles, CVs, messages, images). You warrant that the content is accurate, does not infringe third-party rights and does not violate applicable law.
4.3Job postings must not contain discriminatory requirements, in particular with regard to gender, age, origin, religion, sexual orientation or disability, unless justified by the nature of the work. Fake postings, postings without a specific vacancy and postings for unlawful activities are not permitted.
4.4The Operator is entitled to review content and to remove or block unlawful content or content that violates these Terms without prior notice. There is no entitlement to publication.

- No postings without a genuine intention to recruit
- No sharing of login credentials with third parties
- No harassment of other users via the messaging feature
5. Services for Employers: job credits and packages
5.1Publishing a job posting requires an available job credit. Job credits are purchased in packages; the current packages, prices and durations are shown on the pricing page. Creating and saving drafts is free of charge.
5.2One credit is consumed when a posting is published. A posting remains online for the duration stated in the package unless the Employer pauses, closes or deletes it earlier. Editing a published posting does not consume an additional credit.
5.3Additional services such as highlighting a posting ("Featured"), marking it as urgent or refreshing its publication date may, where offered, be booked for additional credits or fees.
5.4Unused credits expire at the end of the validity period stated at the time of purchase. Credits are not transferable to other companies.
6. Prices, payment and invoicing
6.1All prices are in Swiss francs (CHF) and, unless stated otherwise, include statutory VAT.
6.2Payment is made via the payment service provider Stripe by credit or debit card. The Operator does not store complete card details; these are processed exclusively by Stripe. Credits are added to the account after successful payment; an invoice or payment confirmation is available in the Employer account.
6.3Credits that have already been used are not refunded. For unused credits a refund may be requested from support@jobmarkt24.ch within 14 days of purchase; after this period a refund is excluded to the extent permitted by law.
6.4The Operator may change prices and packages at any time. Changes do not apply to credits already purchased.
7. Applications and handling of candidate data
7.1When an application is submitted, the information released by the Candidate (profile, CV, cover letter, answers to the Employer's questions) is made available to the Employer concerned. Candidates decide themselves which information they submit and may withdraw applications.
7.2Employers may use candidate data exclusively for the specific recruitment process. They must treat the data confidentially, must not pass it on to third parties and must delete it once the process is completed, unless a statutory retention obligation applies or the person concerned has consented to longer retention.
7.3Employers are themselves responsible for compliance with data protection and employment law in the recruitment process, in particular the Swiss Federal Act on Data Protection (FADP) and the Gender Equality Act. For candidate data received via the Platform, Employers are independent controllers within the meaning of data protection law.
7.4Candidate profiles in the talent pool are only visible if the person concerned has explicitly activated this in their settings. Contact may only be made for recruitment purposes.
8. Intellectual property
8.1All rights in the Platform, its design, its software and the content created by the Operator remain with the Operator or its licensors. Users receive a non-exclusive, non-transferable right to use the Platform within the scope of these Terms.
8.2Users retain their rights in the content they post. They grant the Operator the royalty-free right to store, reproduce and display this content for the operation of the Platform and to present it in search results and notifications.
9. Availability and technical changes
9.1The Operator strives for high availability of the Platform but does not guarantee it. Maintenance work, disruptions at third parties (e.g. hosting, payment providers) or force majeure may lead to interruptions.
9.2The Operator is entitled to further develop the Platform technically and to adapt features. Material changes affecting paid services will be announced reasonably in advance.
10. Liability
10.1The Operator is liable only for damage caused intentionally or through gross negligence. Any further liability, in particular for slight negligence, lost profit, loss of data or indirect damage, is excluded to the extent permitted by law.
10.2The Operator is not liable for content posted by users, for the accuracy of job postings, company details or CVs, for the conduct of users towards each other, or for the conclusion or continuation of an employment relationship.
10.3The terms of the respective provider apply to third-party services linked to or embedded in the Platform (e.g. map or payment services).
11. Suspension, termination and deletion of the account
11.1Users may delete their account at any time in the account settings. Upon deletion, profile, CVs, applications and messages are removed unless statutory retention obligations (e.g. for invoicing data) require otherwise. Unused credits expire when the account is deleted.
11.2The Operator may temporarily suspend or permanently close accounts in the event of violations of these Terms, suspected misuse, default of payment or for other important reasons. In the case of serious violations there is no entitlement to a refund of unused credits.
11.3The Operator may terminate the contractual relationship with 30 days' notice. In this case, credits that have been paid for and are still valid will be refunded pro rata.
12. Data protection
12.1The processing of personal data by the Operator is described in the Privacy Policy, which forms part of these Terms.
13. Changes to these Terms
13.1The Operator may amend these Terms at any time. The current version is published on the Platform. Registered users will be informed of material changes by e-mail or at their next login. Changes are deemed accepted if the Platform continues to be used after they take effect. Users who do not agree with the changes may delete their account.
14. Applicable law and place of jurisdiction
14.1These Terms and all disputes in connection with the use of the Platform are governed exclusively by Swiss law, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
14.2The place of jurisdiction is Winterthur. Mandatory statutory places of jurisdiction, in particular for consumers, remain reserved.
15. Final provisions
15.1Should individual provisions of these Terms be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid one that comes closest to its economic purpose.
